Talking Points: The U.S. Senate Should Not Rush a Supreme Court Process

The following talking points are for Leagues to use in developing messages or conducting interviews about the process of confirming a Supreme Court appointee:

A lifetime appointment to the Supreme Court is too important to rush. The Senate needs sufficient time to vet any potential appointee. 

  • Four years ago, Senate leaders set a precedent for how the confirmation process should occur during presidential election years.  

  • The Senate must honor that process and not change the rules in the middle of the game. 

  • The lack of consistency in the process undermines voters’ faith in the system. 

  • We must maintain Americans’ faith in our democracy and the sanctity of the Supreme Court with consistency and not change the process regardless of what party is in control. 

  • In 2016, the Senate left a Supreme Court seat vacant for more than 300 days, and so there is no reason to rush this process.  

  • The average Supreme Court confirmation process takes 68 working days, but far fewer days remain in this Senate’s term. 

  • The American people deserve a Supreme Court confirmation process that builds trust in our system and ensures an independent judicial branch. 

  

The Senate should prioritize protecting our elections and providing relief for millions of Americans who are hurting during this pandemic.  

  • The Senate should focus on helping Americans with a relief package that includes funding to safeguard our elections before focusing on a Supreme Court appointment. 

  • Americans have already started to vote and election officials are spending money to ensure a safe and secure election and so the time is now to support states with the resources to pay those bills. 

  • We need another stimulus package to provide relief for the millions of Americans out of work and struggling to cover healthcare costs due to this pandemic. 

  • Our nation has already lost more than 200,000 souls to this pandemic and it is the responsibility of our elected officials to keep Americans safe and provide COVID care so that we can battle this pandemic effectively together.
