Debate Recording Policy
Leagues can use this sample template when drafting their debate recording policy:
“The recording of this event is owned by the League of Women Voters of [LOCATION] and may not be used for any purpose without the explicit written permission of the League of Women Voters of [LOCATION] except by news media or for nonpartisan voter education. For all other requested uses, reach out to [EMAIL] to request permission to use part or all of the recording. All uses of clips must be linked back to the full recording, must attribute the clip to the League of Women Voters of [LOCATION] candidate debate on [DATE], and must include a disclaimer that views expressed do not reflect those of the League of Women Voters.”
We recommend including the above language stating ownership and permissions of the debate recording in the following places:
- Stated verbally by the moderator before the debate begins and after the debate ends; if the event is being recorded by the League or a broadcast partner, ensure these verbal statements are included in that recording
- In the video description of any live stream or recorded version of the debate
If you are broadcasting in partnership with a media entity or other group, share this standard language with them and work together to develop a policy that you can use jointly.
Candidate Usage Policy
Leagues can use this sample language when drafting their candidate agreements for the debate (in addition to other rules/agreements for candidates):
"By participating in this event, you agree not to use any portion of the video recordings or images of this event for any campaign activities or materials."
Further Guidance
- Leagues must follow FEC rules for federal candidates and IRS rules for any candidate.
- It is not the League's responsibility to monitor or regulate every recording policy violation by the public or third parties. The policy simply helps to protect LWV should a serious need for regulation arise. Leagues may seek counsel about violations at [email protected].
- Always remember: we WANT people to have access to the information we provide by hosting debates and forums.
- According to FEC and FCC rules, press are allowed to cover debates and use clips from debates without permission from the League. Assume best intent when evaluating who is “press.”
